Urine is the most common DOT drug testing method. It detects recent or new drug use, typically in the previous one to three days or could be longer depending on many factors, such as age, metabolism, drug dosage and how long a person has been using. Urine testing is suitable for all testing reasons — from pre-employment to random to post-accident — and can be used to detect a wide variety of illicit and prescription drugs. Currently, urine testing is the only modality approved for DOT federal, safety-sensitive workers.
Federal Motor Carrier Safety Administration ("FMCSA") regulates drivers of motor vehicles in interstate commerce and designates which drivers must be subject to drug and alcohol testing. Under its DOT drug testing regulations:
"All CDL drivers operating commercial motor vehicles (CMVs) (greater than 26,000 GVWR, or transporting more than 16 passengers, including the driver, or placarded hazardous materials) on public roadways must be DOT drug and alcohol tested. This applies to any driver required to possess a CDL, including those employed by Federal, State, and local government agencies, "owner operators," and equivalently licensed drivers from foreign countries. Part-time drivers must also be included in an employer’s drug and alcohol testing program. Drivers who only operate CMVs on private property not open to the public do not require testing."
